Hi Karla,

Vantage appreciate the inconvenience that this issue is causing you and fully understand your frustration. Unfortunately, as we have already expressed, this issue is out of our hands. We are working with outside companies and are forced to work within their timeframes so the required investigations can be conducted.

Firstly, just to clarify, at no point was compensation declined. Vantage did inform you that this was a very complex issue and most likely not the fault of the builder. Unfortunately, we cannot continue, nor are we legally required, to continue to hand out money for issues that are not our responsibility.

Further investigations are required to confirm the exact cause of the flooding, which currently appears to be caused by the rising water table and the blockage of the downhill flow of water by subsequent developments combined with inadequate provisions from council that would allow the natural flow of water from the spring that originally flowed through this general area. This is creating hydrostatic pressure under the slab and footings and forcing its way through the foundations, cold joints at slab/wall/footing junctions. Vantage have been provided a design by the developer and have built to the requirements of this design and engineering.

If the above is confirmed to be the case, it would be an insurable event that would be a matter for body corporate insurance or the building designer/engineer’s professional indemnity insurance to cover. This is a complex issue that will take some time to adequately investigate, confirm the party at fault and then rectify. If it is found that Vantage is at fault you will most definitely be compensated by Vantage.

I have reviewed Jack's handling of your situation and believe that Jack is doing everything he can for you. He has responded to each of your emails and advocated for you in the background to ensure you received the compensation from previous flooding issues. Originally, this matter should have been handled through the real estate and owner. However, when Jack was informed you were vacating the property, he deemed it best to carry out communications between the owner and the contracted management of the property who are the main stakeholders. Jack has been in discussion with the real estate in the meantime and they have been told the same information as above.

We would very much like to see a solution to this complex issue, but the proper procedures need to be followed.
